Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cineflow ("the Service"), operated by Cineflow ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Cineflow is a web-based creative tool that lets you generate images and videos using third-party artificial intelligence models. The Service includes directing controls, prompt assistance, a credit-based usage system, and team accounts that allow members of an organization to share a single credit pool. We may add, change, or discontinue features at any time.

2. Eligibility & Accounts

  • You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
  • You are responsible for the accuracy of the information you provide and for all activity under your account.
  • You must keep your login credentials confidential. Notify us immediately if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms, applicable law, or the rights of others.

3. Subscriptions, Credits & Billing

Access to generation features requires an active subscription or the purchase of credit packs. Payments are processed by our payment provider, Polar (Polar Software, Inc.), which acts as the merchant of record.

  • Subscriptions renew automatically at the end of each billing cycle (monthly or yearly) at the then-current rate, until cancelled.
  • Credits granted under a subscription are consumed as you use the Service and do not roll over between cycles unless stated otherwise.
  • Credit packs are one-time purchases that add credits to your balance.
  • Applicable taxes (including VAT) are added at checkout based on your billing location.
  • You may cancel your subscription at any time in your account settings; cancellation takes effect at the end of the current paid period.

4. User Content

"User Content" means the prompts, reference images, settings, and other inputs you submit, together with the images and videos the Service generates for you ("Outputs").

4.1 Ownership of Inputs

You retain all rights in the inputs you submit. You grant us a worldwide, royalty-free license to process those inputs solely to operate, maintain, and improve the Service, and to transmit them to the AI providers necessary to produce Outputs.

4.2 Ownership of Outputs

Subject to your compliance with these Terms and with the usage terms of the underlying AI providers, you own the Outputs you generate and may use them for personal or commercial purposes. You acknowledge that:

  • AI models may produce similar or identical Outputs for different users; we make no guarantee of uniqueness.
  • Outputs are produced by statistical models trained on large datasets and may unintentionally resemble, reproduce, or include elements drawn from copyrighted, trademarked, or otherwise protected third-party material.
  • Outputs may incorporate elements that are not eligible for copyright protection under the laws of your jurisdiction.
  • We do not warrant that any Output is original, free of third-party rights, or fit for any particular use.
  • You are solely responsible for evaluating each Output and clearing any rights necessary for your intended use, including any commercial use.

4.3 Your Representations

You represent that (a) you have all rights necessary to submit your inputs, (b) your inputs do not infringe any third party's rights, and (c) your use of the Outputs will comply with these Terms and applicable law.

5. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

  • Depicts minors in sexual, suggestive, or exploitative contexts;
  • Constitutes non-consensual sexual content or sexualized deepfakes of real people;
  • Impersonates a real person in a way that is deceptive, defamatory, or likely to mislead;
  • Promotes violence, terrorism, self-harm, or illegal activity;
  • Contains hate speech or targeted harassment;
  • Infringes copyright, trademark, privacy, publicity, or other rights;
  • Is designed to deceive, defraud, or manipulate voters, consumers, or markets;
  • Attempts to bypass safety filters, rate limits, or access controls.

You also agree not to (i) reverse-engineer, scrape, or resell the Service, (ii) use it to train competing AI models, (iii) interfere with its operation, or (iv) use it in violation of export-control or sanctions laws.

6. Monitoring & Removal

We have no obligation to monitor User Content, but we may review submissions, prompts, Outputs, and account activity as needed to enforce these Terms, comply with legal obligations, prevent abuse, or respond to reports of violations. We may remove or refuse to process content that we reasonably believe violates these Terms or applicable law, in our sole discretion and with or without prior notice. Removal does not waive any other rights or remedies we may have.

7. Third-Party AI Providers

The Service relies on third-party AI providers to generate Outputs. Your use of Outputs is also subject to the acceptable use policies of those providers. We do not control and are not responsible for the behavior of third-party models, including any biases, inaccuracies, or offensive content they may produce.

8. Intellectual Property

The Service, including its software, user interface, branding, and documentation, is owned by Cineflow and protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or other proprietary materials.

9. Feedback

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that Outputs will be accurate, appropriate, or suitable for any specific purpose.

We make no representation or warranty as to the originality, legality, accuracy, or fitness of any Output. Outputs may contain errors, biases, offensive material, or content that resembles or incorporates third-party intellectual property. You bear all risk associated with the use, distribution, and reliance on any Output, including compliance with applicable law and third-party rights.

11. Limitation of Liability

To the maximum extent permitted by law, Cineflow and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising from these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD 100.

12. Class Action Waiver

To the maximum extent permitted by applicable law, you and Cineflow each agree that any dispute arising out of or relating to these Terms or the Service will be resolved on an individual basis, and not as part of any class, collective, consolidated, or representative proceeding. You waive any right to participate as a plaintiff or class member in a class action, class arbitration, or other representative proceeding against Cineflow. This waiver does not apply where prohibited by mandatory consumer-protection law in your jurisdiction.

13. Indemnification

You agree to indemnify and hold Cineflow harmless from any claim arising out of (i) your inputs or Outputs, (ii) your violation of these Terms, or (iii) your violation of applicable law or third-party rights.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your account for violation of these Terms, for legal or safety reasons, or if the Service is discontinued. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, governing law) will survive.

15. Changes to the Terms

We may update these Terms from time to time. We will post the updated version here and update the "Last updated" date. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Copyright Complaints & Takedown

We respect the intellectual-property rights of others and respond to credible reports of infringement. If you believe content produced by or hosted on the Service infringes a copyright you own or control, send a written notice to support@cineflow.cam including:

  1. your contact information (name, address, email, phone);
  2. a description of the copyrighted work you claim has been infringed;
  3. a link or sufficient identification of the material you want removed;
  4. a statement that you have a good-faith belief the use is not authorized by the rights-holder, its agent, or the law;
  5. a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights-holder;
  6. your physical or electronic signature.

We may forward complaints to the user whose content is at issue. Repeat infringers will have their accounts suspended or terminated. We are not the merchant of record for these Terms's purposes; complaints relating to a specific purchase should also be sent to our payment partner, Polar.

17. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws principles. The exclusive venue for disputes is the Seoul Central District Court, unless mandatory local consumer-protection law requires otherwise.
